Fort Macleod mayor vows legal action against province over cancelled college
FORT MACLEOD ? The southern Alberta town left reeling from the province?s abrupt cancellation of a $122-million provincial police college wants the Tory government to reverse its decision ? or pay to make up for what?s been lost.
But Solicitor-General Jonathan Denis is firing back at Fort Macleod?s mayor, questioning the town?s losses and suggesting the province likely isn?t on the hook for any more than the $1.9 million it?s already spent on the proposed facility.
Sporting a black arm band to symbolize the community?s loss, Mayor Shawn Patience vowed Thursday the town will pursue all legal options against the province to recover the nearly $4 million it?s committed to utility connections, and additional money to ?mitigate potential future losses that have come as a result of this decision.?
At a news conference overlooking construction of town utility lines to the facility, Patience said a legal fight isn?t what Fort Macleod wants and he called on Premier Alison Redford to meet with council and reverse the decision announced Wednesday.
?This is really about the way this government treats Albertans,? he told reporters and an impromptu crowd of about 50 residents.

The cancellation has caused turmoil in the community of about 3,000, which had been counting on the economic spinoffs of an institution expected to employ 70 to 100 staff while training 400 police officers and 1,000 peace officers annually.
David Arnoldussen, general manager of Scougall Motors, said the car dealership has nearly completed a $5-million new facility it launched, in part because of the police college.
?It?s very devastating,? said Arnoldussen. ?There are other people over ourselves making huge investments in the community.?
The college, intended as a training ground for police across the province, was initially announced by the Klein government six years ago. Outgoing Premier Ed Stelmach confirmed last year the project would go ahead and a construction contract was awarded less than two months ago.
But on Wednesday, Denis announced the project was being scrapped because of concerns over cost and usage of the facility. The Calgary and Edmonton police services, as well as the RCMP, told the government there was little need for a centralized college, he said.
Denis said Thursday it was ?unfortunate? the mayor was threatening a lawsuit and noted it was time to ?cool the tempers a little bit.?
?I don?t agree with a lot of the mayor?s comments . . . the amount of money that he suggests is out,? said the minister. ?I?m willing to look at their figures but at the same time, they don?t match up with ours, frankly.?
Alberta Infrastructure said Thursday there is a contract with the town regarding municipal services needed at the college?s site, but department spokeswoman Jeannie Smith said she could not provide figures on those costs as it would be ?inappropriate? to speculate.
?We did have a contract with the town but as far as amounts go, the town is going to have to figure out their numbers and we?re going to have to figure out our numbers. We?re going to have to sit down and talk about what the costs were at this stage in the game. We don?t have a specific number right now.?
While the building contract was awarded to Bird Design-Build Construction Ltd. in July, only the company ? not the government ? actually signed the document, she said.
Stantec Architecture, which produced the artist renderings of the project, was a subcontractor, she added.

Syria's Assad acknowledges struggles in civil war
BEIRUT (AP) ? In a striking admission, President Bashar Assad said in an interview broadcast Wednesday that his armed forces will need time to defeat the rebels and addressed the string of defections from his authoritarian regime.
The comments amounted to an acknowledgment that even though the opposition lacks the government's tanks and airplanes, their tenacity and tactical creativity ? combined with the military's struggle to fight on multiple fronts ? have yielded a stalemate that could prolong the civil war with many more dead.
Over the past few months, Syria's military has increasingly been stretched thin fighting on multiple fronts against rebels seeking to oust Assad. His forces have been unable to quell the rebellion as it spread to the capital, Damascus, with significant clashes that began in July and to Syria's largest city, Aleppo, a few weeks later. At the same time, the military is fighting smaller scale battles in a string of other cities and towns around the country.
With neither side making significant advances, the conflict is looking more like a war of attrition that could be very drawn out.
"We are fighting a regional and global war, so time is needed to win it," Assad said in an interview with the pro-regime private TV station Dunya. "We are moving forward. The situation is practically better but it has not been decided yet. That takes time," he told the station, which is majority owned by Rami Makhlouf, a cousin of Assad and one of Syria's wealthiest men.
"If the armed forces wanted to use the entire range of its firepower, it can wipe out many areas. But this will be unacceptable," said Assad.
Assad also appeared to make light of the significant number of defections, some of them senior military and political officials, including the prime minister.
"Defections are a positive process. Generally, it is self-cleansing of the state and the nation," said Assad. "If there is a Syrian citizen who knows of someone who wishes to flee but is hesitant to do so he should encourage him," he said with a smile. "Whoever flees is either weak or bad. A patriotic or a good person does not flee."
Assad claimed there were cases when authorities knew in advance of officials who wanted to flee and allowed them to do so unhindered. But he did not provide any specifics to back up the claim.
Taken together with his comments to a visiting Iranian official over the weekend, Assad shows willingness for an even more prolonged conflict, even with more than 20,000 estimated dead in more than 17 months of fighting.
His regime, he told the senior Iranian official, would continue the fight against the rebels "whatever the price."
Some analysts saw the interview as a counter-attack by the regime to burnish its image in the face of recent military gains by the rebels.
Analysts and rights activists say the military has been unable to defeat the rebels in large part because of the tactics of its enemy ? a rag-tag army of civilians-turned-fighters and defected soldiers without a clear chain of command.
"It is extremely difficult to stop an insurrection that has spread so widely, even with far superior firepower, as demonstrated by the U.S. experience in Iraq and Afghanistan," said Chistopher Chivvis, a senior analyst with the Rand Corporation. "The task becomes even harder when there are neighboring countries that support the insurrection"
The insurgents do not have to hold territory and can take advantage of the fact that the military cannot fight as easily on multiple fronts, said Michael W. Hanna, a Middle East expert who monitors the Syrian conflict for the Century foundation in New York.
Hanna also picked up on Assad's claim that the military is holding back on using its full power.
"If the Syrian military wants to retake territory it can do so but will be forced to use disproportionate force," he said. "Such actions run the perennial risk of alienating civilians and creating new motivations for anti-government actions."
Hisham Jaber, a retired Lebanese army general who heads a Beirut-based think tank, argues that Assad's military cannot employ overwhelming force to put down the fighting in Damascus and Aleppo, the country's two largest cities with major political and economic importance.
"Assad may be ready to destroy Homs and Hama (cities in central Syria) but he cannot do that in Aleppo, for example, and does want heavy casualties among civilians," he said. "At the end, a regular army is not suited for guerrilla warfare."
Syrian activists speak of the limitations faced by the regime in using everyone in uniform. Assad's Alawite-led regime, they explain, is unable to trust military personnel from the majority Sunni Muslim sect to fight mostly Sunni rebels.
Assad is a follower of the Alawite sect, an offshoot of Shiite Islam.
Other activists speculate that Sunni pilots have been grounded out of fear they would defect with their warplanes.
On the other hand, they say the rebels are taking advantage of growing logistical and moral support from the civilian population in many areas, while the military was being increasingly seen as an oppressive force that kills with impunity.
Rights groups monitoring the violence now report the deaths of up to 250 or more Syrians on daily basis, though the figures are impossible to independently verify. The fighting has been intense enough to force hundreds of thousands to flee their homes, seeking refuge elsewhere in the country or in neighboring nations.
Assad appeared confident and relaxed in the interview and at times tried to laugh off or make light of serious issues in the conflict.
He responded with a hearty laugh when told by the interviewer about speculations and rumors about his whereabouts.
"I am here with you in Damascus in the presidential palace," he said. "They have not been able until now to instill fear in my heart or the heart of Syrians. Everyone (in Syria) is worried about the country and that's natural. "
Assad has rarely appeared in public since four of his top security officials were assassinated in a July 18 rebel bombing in Damascus.
He sought to deflect any charges of military failure, reverting to his favored rhetoric that the uprising is a conspiracy by foreign powers to weaken Syria.
"What is taking place (in Syria) is neither a revolution, nor a spring. It is a conspiracy," he said, alluding to the Arab Spring revolutions that have topped authoritarian regimes in Tunisia, Egypt, Libya and Yemen.
Assad paid tribute to his supporters at home, saying they stood steadfastly behind him, and also praised the armed forces.
But he criticized the leaders of onetime ally Turkey.
"The state of Turkey bears direct responsibility for the blood being shed in Syria."
Syrian officials routinely cite neighboring Turkey, along with Saudi Arabia and Qatar, as among the rebels' main supporters, providing them with money and weapons.
Turkish Foreign Minister Ahmet Davutoglu said on Wednesday he would press the U.N. Security Council to set up a safe haven inside Syria to protect thousands of people fleeing the violence. Turkey has long been floating the idea of a no-fly zone, or buffer zone, to protect displaced Syrians from attacks by Assad's forces, but the issue has become more pressing now the number of refugees in Turkey has exceeded 80,000 ? a number it says approaches its limits.
"We expect the U.N. to step in and protect the refugees inside Syria, and if possible, to shelter them in camps there," Davutoglu told reporters before leaving for New York to attend Thursday's high-level U.N. Security Council meeting on Syria.
On that prospect, Assad said: "Talk about safe havens does not exist and is unrealistic, even for countries that have assumed the role of a foe."

CHARLOTTESVILLE, Va. (AP) ? A former University of Virginia lacrosse player who killed his ex-girlfriend in a drunken rage was sentenced Thursday to 23 years in prison, slightly less than what a jury recommended.
Jurors said George W. Huguely V should receive 26 years for the May 2010 slaying of Yeardley Love.
Huguely, who is 24, could be released in less than 20 years.
"Unlike Ms. Love, Mr. Huguely still has the majority of his life ahead of him," Charlottesville Circuit Judge Edward Hogshire told the court.
Asked by Hogshire if he wanted to say anything before sentencing, a shackled and tearful Huguely turned to Love's mother, Sharon Love, and sister Lexie and said, "I'm so sorry for your loss and I hope you find peace."
Huguely, of Chevy Chase, Md., was convicted in February of second-degree murder of Love, 22, of Cockeysville, Md., a Baltimore suburb. Jurors also found Huguely guilty of grand larceny.
Huguely and Love, both seniors and varsity lacrosse players at U.Va., had a volatile relationship that spiraled into Huguely's deadly confrontation with Love late on the night of May 2, 2010, after a day of heavy drinking and golfing by Huguely. Love was found the next morning, her battered face in a blood-soaked pillow.
During a 3 1/2-hour sentencing hearing, prosecutor David Chapman presented witnesses who described violent incidents involving Huguely before he killed Love. They included the beating of a friend who went home with Love after a party and the unprovoked punching of another person after a night of drinking. He also angrily wrapped his hands around a young woman in a bar after she told her father, his former high school lacrosse coach, to talk to Huguely about his heavy drinking.
"Sooner or later he was going to seriously injure or kill someone," Chapman said.
Huguely's attorneys acknowledged he drank too much, but Chapman disagreed that was the problem.
"The issue, your honor, is not too much alcohol," he told Hogshire. "The issue here is too much violence."
In a police interrogation video played at his trial, Huguely admitted he and Love had a physical confrontation over their on-again, off-again two-year relationship but he denied inflicting the fatal injuries Love suffered. He said she had banged her head against her bedroom wall.
A coroner concluded she died of blunt force trauma.
Love's death followed several months of tension between the two young athletes. Former teammates and friends testified that each accused the other of infidelity and they described incidents of Huguely's escalating drinking.
The grand larceny conviction stems from Huguely's theft of Love's computer from her apartment.
The Huguely family, many of whom attended the sentencing hearing but did not testify, issued a statement after the sentencing, calling it "a sad day for our family." They also echoed one of Huguely's attorneys, Francis McQ. Lawrence, in his defense of Huguely.
"We continue to believe what Mr. Lawrence said within hours of meeting George, on May 3, 2010: 'Yeardley's death was not intended but an accident with a tragic outcome.' "
Love's family did not address the sentencing hearing but issued a statement that read in part: "We find no joy in others' sorrow."
Lawrence attempted to counter Chapman's depiction of Huguely as a brutish, drunken jock by presenting family members who described him as thoughtful, caring and attentive to the needs of others.
A white-cassocked Roman Catholic priest who had visited Huguely in jail weekly since his arrest more than two years ago described Huguely as spiritual and never saw flashes of anger.
"It's not the same person, the person that the media portrays as the wild, out-of-control person," the Rev. Joseph Scordo said. He described Huguely as his "spiritual grandson."
Chapman argued for the full 26-year sentence recommended by jurors, arguing that Huguely would still be a relatively young man after serving his time. For the Loves, however, "There's nothing left but loss and sorrow, in many ways."
Yeardley Love was to be her sister Lexie's maid-of-honor at her upcoming wedding. "The maid of honor will be missing," Chapman said as Lexie dabbed tears from her face. "He took from them their future as a family."
In reducing Huguely's sentencing, Hogshire strayed from tradition. Virginia judges typically heed a jury's sentence recommendations.
Huguely's attorneys sought a sentence reduction to 14 years.
Virginia has no parole but Huguely could reduce his sentence by 15 percent if he earns credits by participating in prison programs and stays out of trouble. He also would be credited with time served, leaving him with 18 years in prison.
Love's mother, Sharon Love, has filed two lawsuits seeking nearly $60 million. One is aimed at Huguely while the other claims U.Va. and athletic department officials and coaches ignored Huguely's drinking and violent behavior.
Huguely was arrested in Lexington in 2008 after a drunken confrontation with a police officer.
Love's death has had a lasting impact in Virginia and at the university. It's easier now for abuse victims in Virginia to get a restraining order and students must tell the university if they have ever been arrested.
School officials and students also have tried to make the culture on campus one in which people look out for each other and aren't afraid to report relationship violence.
